xahive Privacy Statement
Through the use of cookies, clear gifs/web beacons and other technologies, we and our authorized service providers automatically track and collect certain anonymous data about our site traffic and store it in log files. Traffic data may include Internet protocol (IP) addresses, browser type, domain name, Internet service provider (ISP), referring/entry and exit pages to and from the site, advertising/promotional campaign from which the user linked to the site, operating system and/or platform, date/time stamp, geo-location, number of page views, and page or section accessed. Traffic data is used by us and/or our service providers to track users’ engagement and movements around the site, to analyze trends, to administer the site, to assist us in designing and arranging our web pages in the most user-friendly manner and to improve the site and the software to better meet the needs of users.
When you register with the site, you will be asked to provide certain personal information, including your name and e-mail address. We will identify the purposes for which we use your personal information at the time we collect such information from you and obtain your consent, in any case, prior to such use. We generally will use your personal information for the following purposes: to send you notifications about the site or the software, to respond to your inquiries or requests for support, to provide the services offered, to monitor usage, to improve our services, to detect, prevent an/or otherwise address security or technical issues, to investigate legal claims, to protect our rights or property, to enforce our rights and/or the rights of our licensors, and for such other purposes as may be permitted or required by applicable law.
We will identify to whom, and for what purposes, we will disclose your personal information, at the time we collect such information from you and obtain your consent to our disclosure.
We may share your personal information with third parties that provide services to XAHIVE (including handling and delivering of e-mail communications and electronic newsletters, user submitted information processing and/or storage, web analytic services, e-mail analytic services, and web site hosting and other application services). For example, we may store your personal information along with your files and data on a third party server such as Amazon Web Services; or we may use a third party analytics tool like Kissmetrics to learn how you are using the site and the software, and how we can improve that experience. While generally we will only make disclosures of personal information to persons whom you have consented for us to provide such information, we may also disclose personal information to a potential acquiror of XAHIVE in connection with a transaction for the sale of some or all of our business (rest assured that the use of your personal information by the acquirer would still be limited by applicable law), or as otherwise permitted or required by applicable law. In addition, we may send personal information outside of Canada for the purposes set out above, including for processing and storage by service providers in connection with such purposes. However, you should note that to the extent that any personal information is out of Canada, it is subject to the laws of the country in which it is held, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of that other country, pursuant to the laws of that country.We may also aggregate user information and perform statistical analyses of the collective behaviour of our members and visitors, to measure overall demographics, and to analyze how to improve our service through the use of web analytics services, such as Google Analytics provided by Google, Inc. (“Google”). We may share this information with third parties (such as Google), but although such aggregate information may contain your IP address, it will not contain personal information. In addition, we may compile and disclose aggregate information about our users for promotional or other purposes. For example, we might want to disclose that a certain percentage of our users are located within a particular geographic area or work most frequently in the mornings.
We will never share your personal information with advertisers or send you promotions for unrelated services without your consent. You can access and change your personal information or cancel your account by logging in to your account settings page.
We use session and login cookies, which help us keep track of when a person is logged in and determine the content or sites users link to, and which services people use. We will also capture login timestamps, and usage statistics, as well as IP addresses. We’ll capture some information about your content stored on the site (such as word count, use of various markup tokens, number of versions, etc.), but we will not view the content of your documents unless you give us permission to do so, or it becomes necessary in order to comply with legal obligations.
In connection with the provision of our online services, and in accordance with applicable law, we may collect and use technical data and related information, including technical information about your devices, systems and application software that is gathered periodically, to facilitate the provision of software updates, support and other services to you (if any) related to the downloaded platform application and our online services.
If you access the site through the software, we may in accordance with applicable law collect your GPS location or your device's unique identifier. In this regard, you can control tools on your mobile devices. For example, you can turn off the GPS locator or push notifications on your phone. Each push notification has an "unsubscribe" link. We might also collect the type of mobile device you are using or the version of the operating system your device is running. We may track and collect information regarding how often you use the application on your device and/or when and how often you have downloaded it.
We may keep a record of your personal information, correspondence or comments, in a file specific to you. We will utilize, disclose or retain your personal information for as long as necessary to fulfill the purposes for which that personal information was collected and as permitted or required by law.
If you make a written request to review any personal information about you that we’ve collected, utilized or disclosed, we will provide you with that personal information in accordance with Canadian and US privacy laws. We will make the applicable personal information available to you in an understandable format, and will explain any abbreviations or codes that we use.
We will keep your personal information as accurate, complete and up-to-date as possible. We may expect you, from time to time, to give us written updates to your personal information, if it is required.
At any time, you can challenge the accuracy or completeness of your personal information in our records. If you successfully show that your personal information in our records is inaccurate or incomplete, we will update the personal information as required. Where appropriate, we will also share the updated information with those third parties to whom we’ve provided access to your personal information in accordance with this policy.
We will try to respond to your written requests regarding your personal information with 30 days after we receive your request. We will tell you in writing if we cannot satisfy your request within this time limit. You have the right to make a complaint to the Canadian federal Privacy Commissioner in respect of such time limit.
We will not charge you for your access to your personal information in our records or to access our Privacy Policy or practices without first providing you with an estimate of the approximate costs, if any.
We may request that you adequately identify yourself before we give you access to the existence, use or disclosure of your personal information. Any such identifying information shall be used only for this purpose.
We’ve implemented physical, organizational, contractual and technological security measures intended to protect your personal information from loss or theft, unauthorized access, disclosure, copying, use or modification. The only employees, who are granted access to your personal information, are those with a business ‘need-to-know’ or whose duties reasonably require such information.

We will communicate with you via e-mail, to the e-mail address you provide to us. Some communications, such as e-mails informing you of new features, may be unsubscribed to via the unsubscribe link in the e-mail. If you would like to cease all communications from us, please send an e-mail to sem@xahive.com and we will cancel your account.
We are committed to protecting the on-line privacy of children. In accordance with the United States Children's On-line Privacy Protection Act, we do not, and will not, knowingly collect any personally identifiable information from children under the age of 13. If we learn that personally identifiable information has been collected from individuals under the age of 13, we promptly will take all reasonable steps to delete such information.
